Terms of Service

In short: try LivePen free for 14 days. If you keep it, buy a licence: Annual at $12 a year, or Lifetime at $29 once. A licence is for your own use on up to 3 Macs. You can cancel any time, and you can get a refund within 14 days of paying.

1. Who we are

LivePen (the app and livepen.app) is made and sold by Web Freestyle SRL, a company registered in Moldova, IDNO 1021600031185 (“we”, “us”). You can reach us at support@livepen.app.

Orders are processed by Creem, our online reseller and Merchant of Record. Creem sells the licence to you, takes the payment, handles sales tax and VAT, and issues your receipt and invoice. Creem’s own terms apply to the payment itself.

2. Agreeing to these terms

By downloading, installing, using or buying LivePen, you agree to these terms. If you don’t agree, don’t use the app. If you use LivePen for an organisation, you confirm you may accept these terms on its behalf.

3. Free trial

Every install includes a free 14-day trial with every feature switched on. No payment details or account are needed. When the trial ends, LivePen asks for a licence before you can draw again. Your preferences are kept.

4. Plans and payment

• Annual: $12 per year. It renews automatically every year at the then-current price until you cancel. Creem charges the payment method you used, and emails you a receipt for each renewal.
• Lifetime: $29, paid once. No renewals.

Prices are shown in US dollars. Sales tax or VAT is added at checkout where it applies. If we change the price of the Annual plan, we’ll tell you by email at least 30 days before your next renewal, and you can cancel before it takes effect. A price change never affects a Lifetime licence you’ve already bought.

5. Cancelling

You can cancel the Annual plan at any time from Manage purchase (sign in with the email you paid with), or by emailing us. Cancelling stops the next renewal. LivePen keeps working until the end of the year you’ve already paid for. Cancelling on its own doesn’t refund the current year; see the Refund Policy for that.

6. Refunds

You can get a full refund within 14 days of any payment. The details are in the Refund Policy, which is part of these terms.

7. Your licence

When you buy a plan, we give you a personal, non-exclusive, non-transferable licence to use LivePen:

• on up to 3 Macs that you use yourself. You can move it to another Mac with “Deactivate this Mac” in the app;
• for as long as your plan is active: for good with Lifetime, and until the end of the paid period with Annual.

A licence is for one person. Each person who uses LivePen needs their own. The app checks your licence with our server now and then; this is described in the Privacy Policy.

8. What you may not do

• Share, sell, rent or publish your licence key, or use one key for more people than it covers.
• Get around the trial, the licence check or the activation limit.
• Copy, modify, decompile or reverse-engineer the app, except where the law expressly allows it.
• Redistribute the app or bundle it with something else without our written permission.
• Use LivePen for anything unlawful, or to harass, mislead or harm others.

9. Updates

LivePen updates itself automatically unless you turn that off in Preferences. Annual licences include every update released while the plan is active. Lifetime licences include every future update of LivePen. Updates can add, change or remove features; we won’t remove the core purpose of the app, drawing over your screen, from a version you’ve paid for.

10. Your drawings

What you draw stays on your Mac. We never receive it, and you keep all rights to it.

11. Warranty

We work hard to make LivePen reliable, but it is provided “as is” and “as available”. To the extent the law allows, we make no other promises, express or implied, including that it will be error-free or suit a particular purpose. Nothing in these terms limits rights you have as a consumer that can’t be limited by contract.

12. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits, lost data or a presentation that didn’t go as planned. Our total liability to you for anything relating to LivePen is limited to what you paid us in the 12 months before the claim. None of this limits liability that the law doesn’t allow us to limit, such as for fraud or for death or personal injury caused by negligence.

13. Ending the agreement

You can stop using LivePen at any time. If you seriously break these terms, for example by sharing your licence key publicly, we may end your licence after telling you why. Sections 8 and 10–15 continue after it ends.

14. Changes to these terms

We may update these terms, for example when we add a feature or the law changes. The date at the top shows the latest version. For significant changes we’ll give notice on this site, and by email if you have a plan, before they take effect. If you don’t agree, you can cancel and ask for a refund of any unused paid period.

15. Law and disputes

These terms are governed by the laws of Moldova. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and can bring a claim there. Please email us first: most problems are quicker to fix by talking.
